EarlyMoments Terms and Conditions

1. Account Registration and Roles

To access certain features of the Platform, you must register for an account. We provide different account types based on your role:

School/Staff Accounts: Educators and administrators are responsible for ensuring that all data entered regarding students, fees, and school operations is accurate, current, and legally obtained with the proper consent from parents or legal guardians.

Parent Accounts: Parents and legal guardians are responsible for maintaining the confidentiality of their login credentials. You agree to notify us immediately of any unauthorized use of your account.

Accuracy of Information: All users must provide accurate and complete information during registration. EarlyMoments reserves the right to suspend or terminate accounts containing false, misleading, or unauthorized information.

2. User Conduct and Platform Usage

EarlyMoments provides tools to facilitate early education management and parent-school communication. You agree to use the Platform responsibly and lawfully.

Acceptable Use: You will not use the Platform to upload, post, or transmit any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.

External Sharing: The Platform includes functionality that allows users to share content externally via third-party applications residing on your device, such as initiating a standard WhatsApp message intent. Once you choose to export or share data outside of the EarlyMoments ecosystem, that data is strictly subject to the terms and privacy policies of those third-party services. EarlyMoments has no control over, and assumes no liability for, the security or privacy of information once it is shared outside our Platform.

Platform Integrity: You agree not to introduce viruses, attempt to gain unauthorized access to our servers, or engage in any activity that disrupts the performance or security of the Platform.

3. Payments, Billing, and Refunds

Fees and Taxes: Access to certain features of the EarlyMoments Platform, such as the ERP portal and staff applications, may be subject to subscription fees. All fees are quoted in Indian Rupees (INR). As a GST-registered business, we will clearly state whether the prices displayed for our services are inclusive or exclusive of applicable Goods and Services Tax (GST).

Payment Processing: We use third-party payment gateways to process transactions securely. EarlyMoments does not store your credit card or sensitive banking details. By making a payment, you agree to the terms and conditions of our payment processing partners.

Refund Policy: For our software-as-a-service subscriptions, all fees paid are non-refundable unless otherwise required by Indian law or explicitly stated in a separate written agreement with your school. If an accidental overpayment or billing error occurs, please contact our support team within 7 days, and we will make reasonable efforts to process a refund to the original payment method.

School-to-Parent Payments: If the Platform facilitates fee management between parents and schools, EarlyMoments acts solely as a technological facilitator. We are not responsible for the collection, refund, or management of actual tuition or school fees. Any disputes regarding school fees must be resolved directly between the parent and the school.

4. Intellectual Property Rights

Our Platform: The EarlyMoments Platform, including its underlying architecture, source code, logos, branding, UI/UX design, and text, is the exclusive intellectual property of Jatin Jagia. You are granted a limited, non-exclusive, non-transferable license to use the Platform strictly for its intended purpose. You may not copy, reverse-engineer, or distribute any part of our software.

Your Content: Schools, staff, and parents retain full ownership of the text, photos, and information they upload to the Platform ("User Content"). By uploading User Content, you grant EarlyMoments a worldwide, royalty-free license to host, store, and display that content solely for the purpose of providing the childcare management service to you and your authorized users.

5. Data Privacy and Security

Your privacy is important to us. Our collection, use, and protection of personal data—including sensitive information regarding minors—is governed by our Privacy Policy. By agreeing to these Terms, you also acknowledge and consent to our data practices as outlined in the Privacy Policy, in compliance with applicable Indian data protection laws, including the Digital Personal Data Protection (DPDP) Act, 2023.

6. Limitation of Liability and "As-Is" Disclaimer

"As-Is" Service: The Platform and all associated services are provided on an "as-is" and "as-available" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

Limitation of Liability: To the maximum extent permitted by Indian law, EarlyMoments and its proprietor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Platform.

Liability Cap: In no event shall our total aggregate liability to you for any claims arising out of these Terms exceed the total amount paid by you to EarlyMoments in the one (1) month preceding the event giving rise to the claim.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes, claims, or legal proceedings arising out of or relating to the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located in [Insert Your Primary Jurisdiction, e.g., New Delhi / Haryana / Punjab], India.

8. Modifications to the Terms

We reserve the right to update or modify these Terms at any time to reflect changes to our product or legal requirements. If we make material changes, we will notify you by updating the "Last Updated" date at the top of this document or by displaying a prominent notice within the app or ERP portal. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
